Medical Marijuana was approved Nov. 3, 1998 by 58% of voters. Approved Conditions: Cachexia, cancer, chronic pain, epilepsy and other disorders characterized by seizures, glaucoma, HIV or AIDS, multiple sclerosis and other disorders characterized by muscle spasticity, and nausea. Other conditions are subject to approval by the Alaska Department of Health and Social Services. Patients (or their primary caregivers) may legally possess no more than one ounce of usable marijuana, and may cultivate no more than six marijuana plants, of which no more than three may be mature. The law establishes a confidential state-run patient registry that issues identification cards to qualifying patients.
In November 2014, voters approved a ballot measure to legalize recreational cannabis for adults over 21 and to create business license types for cultivation, manufacturing, testing, and retail.
In 2017, the Alaska’s Marijuana Control Board postponed a decision on proposed rules that would allow cannabis cafés to begin operating. While there was strong support, a backlog of pending applications forced a delay in the discussion until spring. We hope that rules that allow adults a lawful place to consume cannabis can be put in place before tourist season begins this year.
On April 11, 2019 a law went into effect that approves on-site consumption in retail shops – On-Site Consumption Law
