Nevada Medical Marijuana patients may hold up to two and one-half ounces of usable marijuana, including the weight of active cannabinoids in edible marijuana products and marijuana-infused products, in any one 14-day period. They can also possess up to Twelve marijuana plants, irrespective of whether the marijuana plants are mature or immature. Approved Conditions include AIDS; cancer; glaucoma; and any medical condition or treatment to a medical condition that produces cachexia, persistent muscle spasms or seizures, severe nausea or pain, and PTSD. Other conditions are subject to approval by the health division of the state Department of Human Resources.
On November 8, 2016, 55% of Nevada voters approved Question 2, which legalizes, taxes, and regulates marijuana for adults 21 and older. Adults 21 and older with a valid ID can purchase up to one ounce of marijuana or one-eighth of an ounce of marijuana-infused edibles or concentrates from licensed marijuana retail outlets. Retail marijuana sales are subject to a 10 percent sales tax, which state officials estimate will generate more than $60 million in the first two years. On July 1st, 2017 recreational sales began in Nevada.
Dozens of new state licenses for recreational marijuana facilities will be issued during the next few months, in the Fall 2018, to a limited number of applicants, reshaping the landscape of Nevada’s marijuana industry. Per the voter-approved Nevada Marijuana Legalization Initiative, also known as Question 2 on the November 2016 ballot, only current state pot license holders—including cultivators and production facility owners—can obtain the additional 42 recreational dispensary licenses this fall.
