!In Washington, Ballot Initiative I-692, approved by 59% of voters on Nov. 3, 1998 which removed state-level criminal penalties on the use, possession and cultivation of marijuana by patients who possess “valid documentation” from their physician affirming that he or she suffers from a debilitating condition and that the “potential benefits of the medical use of marijuana would likely outweigh the health risks.”
Medical Marijuana Dispensaries became legal with Senate Bill 6032 by the Washington legislature in 2007 and became effective Nov 2nd, 2008. Gov. Christine Gregoire signed sections of the Bill 5073 and partially vetoed others, on Apr. 29, 2011 allowing the state to continue to sell medical marijuana. Then on Nov. 6, 2012, Washington voters passed Initiative 502, which allows the state to license and regulate marijuana production, distribution, and possession for persons over 21 and tax marijuana sales. In Oregon, Ballot Measure 67, approved by 55% of voters on Nov. 3, 1998 which revmoed state-level criminal penalties on the use, possession and cultivation of marijuana by patients who possess a signed recommendation from their physician stating that marijuana “may mitigate” his or her debilitating symptoms.
HB 3460 signed by Gov. John Kitzhaber on Aug. 14, 2013 created a dispensary program by allowing the state licensing and regulation of medical marijuana facilities to transfer marijuana to registry identification cardholders or their designated primary caregivers. Ballot Measure 91 was a 2014 ballot measure, which passed with 56%. Its passage legalized the “recreational use of marijuana, based on regulation and taxation to be determined by the Oregon Liquor Control Commission.”
